1. TERMS
These Terms and Conditions of Entry, including information on how to enter and prizes form part of these Conditions of Entry. Entry into the Promotion is deemed to be acceptance of these terms.

2. ENTRY
2 (a) The promotion is ‘open submission’ however all images must be taken in Sydney.

2 (b) The Promoter reserves the right, in its sole discretion, to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry, or engaged in any unlawful or improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion.

2 (c) Multiple entries per person are permitted as long as each creative response to the Promotion Post is original in concept and substantially different from prior entries from a single entrant. Submitted photos may have been previously published.

2 (d) Entrants must enter using an Instagram account registered to them individually or to your small business /startup Instagram account. If it is a business account, proof must be provided of ownership of the business account.

2 (e) No responsibility accepted for late, lost or misdirected entries.

2(f) To enter, entrants must
i. Follow the Instagram account of @whtvr.co and @thebeastmag
ii. Post their #mysydney picture on their Instagram wall tagging @whtvr.co plus @thebeastmag and use the hashtags #mysydney #whtvr #thebeastmag
iii. In the same post, caption their photo of what and where it is

2 (g) All entries are deemed to be received at the time of receipt into the Promoter’s promotional database and not at the time of transmission by the entrant.

2(h) By participating and uploading a Photograph, the participant confirms that:
he/she is the sole owner and copyright owner of the photograph entry(s)
he/she agrees to not submit any photographs of a pornographic or illegal nature and that the Promoter reserves the right to disregard any images of such nature
he/she has permission from anyone pictured within the content
the photograph(s) are taken in Sydney, NSW, Australia
Entries may only be made by the authorised account holder of the instagram account you post your image on at the time of entry. Robots / spambots need not apply.

2 (i) Eligible entrants
Professional and amatuer creatives / locals and small businesses / startups are encouraged to submit, this competition is based on creativity and talent, not the number of spambot likes you can get
Only the person/ small business owner that has taken the photograph can submit his or her image. Images may not be submitted by third parties on behalf of someone.
WHTVR local creator ambassadors are not permitted to enter

3. PROMOTION PERIOD
Promotion commences Tuesday 18 October 2016 and will close at midnight AEST Monday 28 November 2016 (Promotion Period).

4. JUDGING PERIOD & FINALIST + WINNER ANNOUNCEMENTS
4 (a) There will be two judging periods:
The first will be to shortlist the 10 finalists, this will be conducted on Tuesday 29 November 2016
The second and final judging will take place Tuesday 29 November – Thursday 1 December 2016 whereby the winner of the $10,000 prize pack will be chosen.

4 (b) All eligible entries will be assessed in the judging process. The 10 finalists shortlisted will be notified via Instagram direct message requesting for them to email their contact details to hello@whtvr.com.au on or before Thursday 1 December. Judges’ decision is final and no correspondence will be entered into.

4 (c) The winner will be notified via email and on the WHTVR Instagram account on 11 December 2016. Judges’ decision is final and no correspondence will be entered into. Incomplete, illegible or indecipherable entries are invalid.

5. GAME OF SKILL 
This is a competition of skill and chance plays no part in determining the winner.

6. PRIZE OVERVIEW
6 (a) Total prize pool value of the $10,000 #mysydney by WHTVR package is

WHTVR Website & Brand Package
The prize includes a WHTVR Professional Website Package + WHTVR Professional hosting and a WHTVR Professional Brand identity to the total of AUD $6,000 RRP inc GST . Details on inclusions in our packages can be found on our website whtvr.co/pricing. Website brief and content must be received by February 24 2016

QT Hotel Package
The winner will enjoy a luxurious 4 night stay in one of the QT Bondi King Deluxe Rooms. A total value of $1900. This offer is non-transferrable, is subject to availability and cannot be combined with any other offer. Valid for bookings until 1st October 2017 and block out dates apply. This offer is only valid for two people under one reservation in a QT King Deluxe. Please present voucher on check-in.

The Beast Magazine Editorial Prize
The winner will be announced in the January edition of The Beast magazine and will earn themselves a full page editorial interview, featured winning image and feature alongside all nine other finalists in a double page photospread. The winner will need to make themselves available for the interview. to answer the questions. Total value is worth over $2200.

Photoking Prize Package
The total prize package from Photoking is worth $1500 and includes 10 x $150 Photo printing vouchers. Prizes are to be used by 31st November 2017. $150 worth of photographic printing (printing on photo papers in house) includes GST. All prizes are not transferable or exchangeable and cannot be taken as cash.

6 (b) By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed, photographed and filmed.

6 (c) In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize. The winner acknowledges that the Promoter is free to use the photographs and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use

6 (d) The $10,000 ‘#mysydney by WHTVR package will be announced to the winner on the 11 December 2016 to use on whatever business / brand they desire. Once we announce the winner, someone from the WHTVR team will meet with the winner face to face or via Skype to arrange a mutually beneficial time to be briefed on your project and then we will make your creative ideas a reality. The project must be confirmed with WHTVR by January 31 2016 and the prize package deliverables will be subject to WHTVR’s standards Terms of Service and Rules of Engagement.

7. PROMOTION OVERVIEW
7 (a) If for any reason this Promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion.

7 (b) The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or downloading any materials in this Promotion.

7 (c) Any costs associated with accessing the internet is the entrant’s responsibility and is dependent on the Internet service provider used.

7 (d). The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of participating in this promotion or accepting any of the prizes, except for any liability which cannot be excluded by law. Each entrant also releases Instagram from any liability for any loss or damages whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of participating in this promotion or accepting any of the prizes, except for any liability which cannot be excluded by law.

7 (e) In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion subject to any written directions from the various State and Territory lottery departments.

7 (f). The Promoter reserves the right to request the winner to provide identification of identity and proof that the image is solely owned by the winner. Identification considered suitable for verification is at the discretion of the Promoter.

8. OWNERSHIP
8 (a) All entries become the property of the Promoter. The Promoter collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. A request to access, update or correct any information should be directed to the Promoter at their address set out below. All personal information will be securely stored by the Promoter.

8 (b). Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products and services manufactured, distributed and/or supplied by the Promoter.

9. This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram. Entrants understand that they are providing their information to the Promoter and not to Instagram. The information entrants provide will only be used in accordance with these terms and conditions.
